Summary
Faculty, staff, and students are encouraged to make good faith reports of ÐÓ°É´«Ã½-related misconduct. Retaliation as a response to such disclosure will not be tolerated.
HR Policy Provisions
- Definition
- A good faith report is the disclosure of ÐÓ°É´«Ã½-related misconduct made with a belief in the truth of the information which a reasonable person could hold based upon the facts.
- A disclosure is not made in good faith if made with knowledge of its falsity or reckless disregard of the facts.
- ÐÓ°É´«Ã½-related misconduct includes any activity which affects the ÐÓ°É´«Ã½ by a ÐÓ°É´«Ã½ department or by any ÐÓ°É´«Ã½ employee which is in violation of any state or federal law or ÐÓ°É´«Ã½ policy.
- A good faith report is the disclosure of ÐÓ°É´«Ã½-related misconduct made with a belief in the truth of the information which a reasonable person could hold based upon the facts.
- Reporting
- Information of ÐÓ°É´«Ã½-related misconduct of illegal, improper or dishonest acts should be reported to an employee's supervisor or other ÐÓ°É´«Ã½ official or other reporting mechanism established by the ÐÓ°É´«Ã½.
- Such acts would include, but not be limited to:
- corruption,
- burglary,
- theft of ÐÓ°É´«Ã½ property,
- fraud,
- coercion,
- discrimination,
- sexual harassment,
- civil rights violations,
- misuse of ÐÓ°É´«Ã½ property, and
- conflicts of interest.
- Such acts would include, but not be limited to:
- Remedies to address ÐÓ°É´«Ã½-related misconduct may include termination of employment, requirement of restitution and presentation of such information to the appropriate authorities for criminal prosecution.
- Information of ÐÓ°É´«Ã½-related misconduct of illegal, improper or dishonest acts should be reported to an employee's supervisor or other ÐÓ°É´«Ã½ official or other reporting mechanism established by the ÐÓ°É´«Ã½.
- Retaliation
Any threat of or attempt to penalize or retaliate against an employee for filing a good faith report or participating in the investigation of a good faith report regarding ÐÓ°É´«Ã½-related misconduct will be considered a separate and distinct violation of ÐÓ°É´«Ã½ policy.
